British Airways Has Reached a Settlement in a UK Breach Class Action

On July 6, 2021, it was announced that British Airways (“BA”), which is owned by International Consolidated Airlines Group, S.A, had settled a UK class action lawsuit relating to a 2018 data breach that affected approximately 430,000 data subjects.
The UK Information Commissioner’s Office (“ICO”) previously fined BA £20 million for the same breach, after determining that BA had failed to process its customers’ personal data in a secure manner, as required by Article 5(1)(f) and Article 32 of the EU General Data Protection Regulation. The ICO’s proposed fine of more than £183 million was significantly reduced to this amount.
The settlement amount was not disclosed, and BA made no admission of liability as part of the agreement. With over 16,000 claimants, it was the largest class action personal data claim in the UK to date.
