EU-UK Adequacy Decisions Finalized

The European Commission adopted two appropriate decisions concerning the transfer of personal information to the United Kingdom in accordance with GDPR and the Directive on the implementation of the law, respectively on 28 June 2021 and within 48 hours from the expiry of the post-Brexit grace period under the Trade and Cooperation Agreement between the United Kingdom and Germany (together, the UK Adequacy Decisions).

Both texts prohibit personal data transfer to ‘third countries,’ unlessEU-UK Adequacy Decisions Finalized

(a) an appropriate decision or (ii) appropriate safeguards (for example standard contractual clauses (see here) or codes of conduct (see our warning here), are provided for in that country; or (b) a limited derogation under Article 49 GDPR applies.The UK Adequacy Decisions will enable a smooth flow of data on the basis of a six-month time race between the United Kingdom and the European Union.
